Najib's RM20 million plot

KUALA LUMPUR (Harakahdaily) - Self-exiled blogger Raja Petra Kamaruddin has revealed a document on his Malaysia Today website, said to be an investigation paper by the then Anti-Corruption Agency (ACA).

Among others, the document dated December 10, 2008, appears to confirm allegations that Parti Keadilan Rakyat's Kulim state assemblyman Lim Soo Nee had been offered RM5 million to leave his party in 2008 as part of a plot to bring down the Pakatan Rakyat state government through defections.

Zombie Rightful Menteri Besar

PUTRAJAYA, May 22 -- A three-man bench of the Court of Appeal, in a unanimous decision, today declared Datuk Seri Dr Zambry Abdul Kadir as the rightful menteri besar of Perak.

The court held that the order made by the High Court on May 11, in declaring Datuk Seri Mohammad Nizar Jamaluddin as the legitimate menteri besar, was wrong and set aside that decision.

"The learned High Court judge had failed to properly and adequately appreciate the entire evidence before him, and that rendered the decision as wrong," said Justice Datuk Md Raus Shariff, who sat with Justices Datuk Zainun Ali and Datuk Ahmad Maarop.

Both Mohammad Nizar and Zambry were not present in court today.

Justice Md Raus, in his oral judgment, also held that the Sultan of Perak, Sultan Azlan Shah, was right in appointing Zambry as the new menteri besar, under Article 16(2) of the Perak Constitution, after being satisfied that Zambry had the command of the majority of the state legislative assembly.

"We hold the view that the granting or the withholding of the request for the dissolution of the state legislative assembly is the royal prerogative.

"On the facts of this case, the request for the dissolution of the state legislative assembly was made under Article 16(6) of the Perak Constitution and not under Article 36 of the constitution," said Justice Md Raus in allowing Zambry's appeal against the High Court decision.

Justice Md Raus further held that the Sultan of Perak was right in making enquiry to satisfy himself that the respondent (Mohammad Nizar) had ceased to command the majority confidence.

The fact that Mohammad Nizar had ceased to command the majority confidence could be obtained or established alternatively, he said.

"There is no mandatory or expressed requirement in the Perak Constitution that provides that there must be a motion of no-confidence to be tabled against the respondent before deciding that he had ceased to command the majority confidence of the state legislative assembly," he said.

Raja Nazrin defends monarchy against ridicule

KUALA KANGSAR, April 19 – The Raja Muda of Perak, Raja Dr Nazrin Shah today said he would take on the primary responsibility of implementing all efforts to ensure that the institution of royalty which was core to the system of governance and nationhood in the country would continue to be protected.

“An offspring will not allow the dignity and sovereignty of a ruler to be ridiculed. As such the people must be conscious not to be hasty to throw the lamp away, as daylight too will end. “Let it not be that as night falls, people grope about directionless, blanketed in darkness without a lamp,” he said at the pledging of loyalty and awards ceremony in conjunction with the 81st birthday of the Sultan of Perak, Sultan Azlan Shah at Istana Iskandariah here today.

He said the Malay rulers were not just symbols in the country but that the Malay Sultanate had an important role as the centre of strength for the people.

Raja Nazrin said the administrative system with Malay Sultanate as its core had been in place for more than 600 years and had succeeded in developing a great culture and civilization.

He said the wisdom of royalty aided the developmental process of intellectuality and from the palace emanated great works of art in writings.

“The Malay rulers are the symbols of sovereignty – the symbols of citizens’ strength – the umbrella for the country’s crown. The Malay rulers give identity to the nation. “People who understand the culture of monarchy, will understand the philosophy of royal administration, the role of rulers, especially the role and responsibility of holding up national identity,” he said.

He said the continuity of a race and the face of a nation depended on factors that gave it identity from the aspects of institutions, religion, culture and language.

“Actions of insulting institutions, ridiculing institutions, fermenting hatred towards institutions are early steps in the movement towards abolishing the institutions – therefore abolishing the original identity of the country’s race.

“During the Cold War, such steps came from groups who held on to left-wing political doctrine and were categorised as subversives.

“In the name of the Cultural Revolution in China and communist indoctrination in Cambodia and Vietnam, children were incited to extreme levels, hating and making enemies of their own parents; religious leaders were criticised and places of worship destroyed; some places of worship turned into places to breed animals; leading to anarchy that had to be paid with lives and blood; and the social fabric destroyed,” he said.

Raja Nazrin said the world now faced waves of globalisation – waves that hit all borders – to break down cultural walls and possibly drowning national history.

He said the younger generation which was being hit by the globalisation waves should be wise to balance claims of tradition and demands of modernity.

He said there were some who believed that to progress, focus must be on a progressive culture and they said that traditions and history would cause backwardness in a static culture.

“Globalisation actually brings waves of new colonialism to drown the traditions of a country, wiping out original identity.

“People must be aware that not all that is traditional hinders progress as tradition that is interpreted wisely and intelligently can function to bring progress.

“The cultural elements that have been factors of unity till this day are priceless social capital that should be defended,” he said.

Perak Mentri Besar Datuk Dr Zambry Abdul Kadir and his six suspended state executive council members are seeking a second opinion from a Queen’s Counsel in London on the constitutional impasse in the state.

According to a source close to the Barisan Nasional, a senior lawyer is leaving for London Monday to meet with the QC.

One of the assemblymen and other lawyers will also be part of the group, said the source.

“The team comprises old and new young lawyers, there is one who was involved in the two chief ministers case in Sabah in 1986.

“They are going to for a second opinion on the purported suspension of the Perak MB and the six assemblymen as well as the suit filed (by Datuk Seri Nizar Jamaluddin on Feb 13) that the MB (Dr Zambry) is purportedly not the MB.”

The constitutional crisis in Perak began early this month after two PKR and one DAP assemblymen left their parties, leading to Nizar to seek Sultan Azlan Shah’s consent to dissolve the state assembly. On Feb 5, the ruler instead declared the Pakatan Rakyat government had lost its majority and appointed Barisan’s Dr Zambry as Mentri Besar.

Nizar and his team have refused to quit and the crisis is now a well truly a constitutional quagmire after State Legislative Assembly Speaker V. Sivakumar on Feb 18 suspended Dr Zambry and his executive council from the assembly for 12 and 18 months, respectively.

Asked whether the lawyers had been instructed by Barisan, the source said they were acting on behalf of Dr Zambry and the six exco members and took instructions from them as the aggrieved party.

On whether they would apply for a QC to represent them in court, the source said:

“No. In addition to seeking a second opinion, they also want an opinion on the position in other Commonwealth jurisdictions, apart from the Sabah and Sarawak cases here.”

Asked whether the legal eagles were getting a QC’s opinion because several legal experts have described the legal impasse as “uncharted constitutional territory”, despite the East Malaysian case precedents, he replied:

“They think the Federal Constitution has been stretched to extreme limits. See how the Speaker unilaterally acted in convening the Rights and Privileges Committee when the Dewan was not in session and suspending the MB and his exco members.”

“That is a clear and direct contravention of the assembly’s Standing Orders and convention as practised in Parliament.”

Asked whether the state legal adviser would represent Dr Zambry and the six in court, the source said that because they were suspended as assemblymen, the question of whether the state legal adviser could do so in that case and act for Dr Zambry in Nizar’s application for a judicial review was also a matter they were seeking a second opinion of from the QC.

IPOH: Mentri Besar Datuk Dr Zambry Abd Kadir has appealed to the people to accept the Sultan of Perak’s decision to appoint him to rule the state.

Dr Zambry said he was aware that people were wondering whether he was truly the MB.

“I understand the question and I want to make it clear that I would not be here if my position was considered illegitimate and illegal.

“I ask from the heart that we show our readiness to the Sultan,” he said during his inaugural meeting with school principals and headmasters at the state secretariat here on Saturday.

Dr Zambry urged the people to not be overcome by emotion and to view the situation in an objective manner.

Saying he did not want to influence everyone, he called on them to look objectively at the actual causes behind the crisis recently taking Perak by storm.

“Please come to your senses. A person who is overcome by anger will not be able to come to the best decision. Let us show respect to the Sultan,” he added.

Dr Zambry added that he would not let the political crisis of the past few days, since he and his exco members were barred from assembly sittings, affect his duties as mentri besar.

What Al Jazeera Says About Malaysia.

The chief minister of a Malaysian state and his six member cabinet have been barred from attending the state parliament, in the latest move of a growing political crisis pitting the country's opposition against the ruling coalition and royalty.

On Wednesday V Sivakumar, the speaker of the assembly in the northern state of Perak, ordered the suspensions of Zambry Abdul Kadir and six others from the ruling Barisan Nasional (National Front) coalition.

In a statement, Sivakumar, a member of the opposition Pakatan Rakyat (People's Alliance) coalition, said he was suspending Zambry for showing contempt to the house by taking office unconstitutionally last month.

"I have decided that Zambry is, with immediate effect, suspended and barred from attending State Assembly sessions for 18 months while the six [cabinet] members are barred for 12 months," he said in the statement.

If the suspensions stand, the balance of power in Perak will return to the opposition.

Zambry and his colleagues replaced an opposition government, which won control of the state in general elections last March, but lost power following the defection of three of its members in January.

The March elections saw the ruling BN score its worst result in more than five decades in power, losing control of Perak and four other states and seeing its majority in the national parliament radically reduced.

Defections

The Perak crisis has sparked allegations that the opposition defectors were bought over by Umno (United Malay National Organisation), the dominant partner in the BN coalition.

The escalating stand-off in the state comes as Umno's Najib Abdul Razak, Malaysia's prime minister-in-waiting, faces party elections next month.

Following the defections, the state's hereditary ruler and titular head, Sultan Azlan Shah, appointed Zambry as the new chief minister.

The opposition claimed the sultan had acted unconstitutionally in making the appointment without waiting for a vote of confidence in the state assembly.

Sivakumar, the Perak speaker, also questioned the sultan's decision, a move fraught with risk of igniting racial conflicts.

Sultans in Malaysian states are highly respected and considered beyond reproach by most Malays, the country's ethnic majority, who also believe that decisions by sultans should not be questioned, especially by non-Malays.

'Abuse of power'

According to The Star newspaper, Zambry, the ousted chief minister, has described the suspension order as a joke that he said made a mockery of the system.

"The suspension is tantamount to not respecting the sultan," Mah Hang Soon, one of Zambry's suspended cabinet members, said.

Hamdi Abu Bakar, an associate of Zambry, said the suspended legislators would continue to work as normal.

"The speaker has no right to do that. It's an abuse of power," he said.

Last Friday, Mohammad Nizar Jamaluddin, the former opposition chief minister, filed a legal suit challenging the legitimacy of his successor and the new state government.

Idiot tells Zombie to lodge police

PUTRAJAYA: Datuk Seri Abdullah Ahmad Badawi has asked Perak Mentri Besar Datuk Dr Zambry Abd Kadir to lodge a police report against state assembly speaker V. Sivakumar.

The Prime Minister said he had spoken to Dr Zambry about his suspension and was of the opinion that he should lodge a police report, adding that the mentri besar “was of the same opinion.”

On Wednesday, Dr Zambry and all six state executive council members were suspended and barred from the state assembly for allegedly showing contempt for the House. Dr Zambry was suspended for 18 months, the others for 12 months each.

Sivakumar, who heads the Committee of Special Privileges that summoned the seven to answer to a complaint, made the order on grounds that they had failed to give any explanation.

Abdullah told Dr Zambry and his exco to “continue attending the state assembly, and to serve the state and its people.”

Perak Speaker has suspension powers

KUALA LUMPUR, Feb 18 — The Perak Speaker acted within his powers when he barred Menteri Besar Datuk Zambry Abdul Kadir and six executive councillors from the next sitting of the state legislature, in the latest move arising from the constitutional crisis in Perak, said a law expert today.

Abdul Aziz Bari, a law professor at the International Islamic University here, told The Malaysian Insider that the Speaker’s authority covers a very wide area in matters involving the assembly’s regulations.

“That includes the finality on the interpretation of provisions in the Standing Orders, the rules which govern the House,” he said.

Veteran lawyer, Karpal Singh, concurred.

Karpal, who is also the DAP chairman, said that while V Sivakumar is a first-term Speaker, he is absolutely within his rights to act as he did today.

Earlier today, Sivakumar announced that Zambry would not be allowed to take part in the state assembly’s proceedings for the next 18 months, following a probe by the state assembly’s Special Privileges Committee.

Sivakumar added that six other BN state lawmakers would also not be allowed in for the next 12 months.

The committee had acted following complaints that the seven state assemblymen were appointed unconstitutionally.

Abdul Aziz observed that at the federal level, the Speaker of the Dewan Rakyat has previously made some “absurd and illogical decisions — rejecting motions and suspending members, among others”.

“Now it is the turn of the BN to taste that,” he noted.

Pakatan Rakyat’s (PR) Datuk Seri Mohammad Nizar Jamaluddin maintains he is still the lawful menteri besar of Perak as he has neither resigned from his post nor has he been voted out by the majority of assemblymen in the state legislative assembly.

His civil suit against Zambry, filed last Friday challenging the Pangkor assemblyman for usurping his authority, was heard this morning at the High Court here.

Abdul Aziz said that Nizar has a right to stake his claim in court as it is based on the “dubious position of Zambry’s government”.

He added that the state government “owes its position” to the majority in the legislative assembly.

“This is the problem as we are not sure whether Zambry’s got that,” the professor said.

Nizar vs Zambry: Malaysiakini

KUALA LUMPUR: High Court Judicial Commissioner Mohamad Arif Md Yusof has offered to recuse himself from hearing the lawsuit filed by former Perak mentri besar Datuk Seri Mohd Nizar Jamaluddin against his successor Datuk Dr Zambry Abdul Kadir.

The suit was filed after the Pakatan Rakyat government lost the state to Barisan Nasional with the resignation of three assemblymen from their parties, and the defection of a fourth.

Nizar wants the court, by way of judicial review, to declare him the legitimate mentri besar and for an injunction to stop Dr Zambry or his agents from carrying out the duties and functions of the mentri besar.

At the onset of the proceedings Wednesday, Mohamad Arif said he has been a legal advisor and counsel for PAS on a number of election petition cases. Nizar is a member of PAS, which together with PKR and DAP, makes up the Pakatan alliance.

“I have also been involved in PAS legal matters from time to time, and have advised PKR on legal issues,” Mohamad Arif said.

“I have also acted for Barisan in an election petition in Sarawak,” he added.

“I tend to think that to preserve justice and the integrity of the institution, perhaps I should recuse myself from hearing this matter,” he said.

He set Feb 23 for counsel from both sides to brief him on whether they had any objection to him hearing the matter, as well as on two other issues:

First, whether the matter should be referred to the Federal Court over the question of law for determination and finality, over intepretation of Article 16(6) of the Perak Constitution.

Second, on the standing of Perak’s state legal advisor Datuk Ahmad Kamal Md Shahid acting as counsel for the respondent since Dr Zambry is being sued in his personal capacity.

The five-page suit, filed last Friday, also asks for “punitive, aggravated and exemplary” damages to be awarded to Nizar.

PETALING JAYA: The prime minister will brief the Council of Rulers on the political development in Perak at its next meeting

Datuk Seri Abdullah Ahmad Badawi will brief the Council of Rulers on the political development in Perak at its next meeting.

He said it was up to the Council of Rulers to deliberate and make a decision on the matter.

On calls from quarters in Umno for the Council of Rulers to convene a special meeting to discuss what they deemed as an a disrespect by the Opposition against the Malay Rulers following the situation in Perak, Abdullah said the Council of Rulers met once every three months.

“I will also be present and possibly will brief the meeting on what has happened and the reasons.

“Any view or decision on the matter will be up to the rulers. I am only responsible for providing information on what has happened,” he said after launching the Hutan Kita - Kiara Our Forest programme at Taman Bukit Kiara in Taman Tun Dr Ismail on Sunday.

On the Perak State Assembly Speaker, he said the Government had yet to decide on who would become the new Speaker.

On the position of Pakatan Rakyat’s Tronoh assemblyman V. Sivakumar who has maintained he is still the Speaker as he was voted Speaker through the state assembly and could only be relieved the same way, Abdullah said: “There will be approaches that we will use to replace the Speaker later.”

Embarrassing Dinner by The Malay Rulers - Malaysiakini

KUALA KANGSAR, Feb 14 — Seating arrangements were thrown off kilter at the Istana Iskandariah in Kuala Kangsar tonight when Datuk Seri Nizar Jamaluddin turned up for Sultan Azlan Shah's silver jubilee celebrations.

Besides injecting particularly awkward moments into the occasion, Nizar's appearance was an obviously tactical move in his claim to be still the legitimate Perak menteri besar.

"We came to celebrate the silver jubilee together because we planned it many months ago. I was the head of the planning committee," Nizar told reporters just before he entered the palace.

Palace officials trying to avoid creating any embarrassing scenes did not turn Nizar away but he was not ushered to any of the main tables where Barisan Nasional dignitaries like Prime Minister Datuk Seri Abdullah Ahmad Badawi and Datuk Seri Najib Razak were seated.

He was also not ushered to keep Datuk Zambry Abdul Kadir, the man whom the Sultan swore in to replace him as MB and who he is suing for the job, company.

Instead, he was seated with two federal deputy ministers — Husni Hanadzlah and Kong Cho Ha, who are from Perak.

Also at the dinner were the other Malay Rulers and representatives.

Nizar continues to maintain he is menteri besar and has refused to resign even though he was directed to do so by the Sultan.

As a result he is now embroiled in a constitutional dispute with the state Ruler as he contends that the Sultan did not have powers to dismiss him as MB.

Perak impasse moves to the courts - Malaysiakini

KUALA LUMPUR, Feb 13 — Datuk Seri Nizar Jamaluddin's Pakatan Rakyat administration is naming newly sworn-in Perak Menteri Besar Datuk Dr Zambry Abdul Kadir as the sole defendant in a suit filed here today to declare the Barisan Nasional government illegal.

Nizar is seeking to have his administration declared the legitimate government in Perak, and by naming only Zambry, his legal team appears to be targeting the new MB as a focal point in the power grab instead of the Perak Sultan.

This strategy is designed to deflect attention from Sultan Azlan Shah, who has come under heavy criticisms for deciding to effectively dismiss Nizar, which is something some constitutional experts argues he does not have a right to do, and to appoint a new MB from BN.

Umno and BN are now attempting to galvanise Malay support in particular behind the Malay Rulers and to portray PR leaders as traitors.

At the Kuala Lumpur court complex here this morning, Nizar led a group of about 50 supporters in chants of "Hidup Rakyat" as he walked in to file the court case.

Rafidah Azizi: The Lady That Talk Rubbish - Malaysiakini

KUALA LUMPUR: Wanita Umno chief Tan Sri Rafizah Aziz has called on the authorities in Perak to take action against Datuk Seri Mohammad Nizar Jamaluddin and his executive councillors for defying the orders of the Sultan of Perak. Sultan of Perak???? I thot he's one of the UMNO members..!!!

She said their refusal to step down despite being ordered by Sultan Azlan Shah was a “shameful act” and showed “wanton disrespect towards the ruler.”

“It is clear that they refused to accept and respect the decision of the Sultan who acted in accordance with the state constitution,” she said in a statement.

Rafidah, who is Kuala Kangsar Member of Parliament, also called for action against them for holding a state executive council meeting and making executive decisions even though they were allegedly no longer in power.

She claimed said that their actions could result in confusion among the people.

Pro-Robbers Groups Protest - Malaysiakini

IPOH: Groups of people took to the streets in the states of Malacca and Perak to pledge their support for the Sultan of Perak and to hit out at Pakatan Rakyat leaders for contemplating legal action against him.

Hundreds gathered here at the car park of the Perak Umno headquarters on Sunday. They were planning to the Istana Kinta to show their support for Sultan Azlan Shah, but police managed to disperse the crowd.

The gathering was organised by Barisan Bertindak Perpecahan Melayu Malaysia (Malay Unity Bastard Front of Malaysia), whose president Mr. Idiot Osman Abu Bakar called for all Malays to disregard their political beliefs and stand united behind the Robbers

They carried banners with slogans such as “Daulat Tuanku (Long live your majesty)”, “Lucutkan Kerakyatan Karpal Singh (Revoke Karpal Singh’s citizenship)” and “Nizar menderhaka (Nizar is treacherous).”

UMNO THE REAL BASTARDS

At about 11.15am, the group prepared to march to Istana Kinta about 300m away, but Ipoh OCPD ACP Azisman Alias stepped in to interrupt the proceedings.

MY DEAR SULTAN. THE RAKYAT INVITED YOU TO BE A CANDIDATE.

“You can gather here because it is a private compound but I cannot allow you to march to the palace. It is a public road out there, and we have closed the road for four days for security reasons.

“So please cooperate and keep the gathering here,” he told the crowd.

The organisers obeyed ACP Azizman’s directive and asked the crowd to stay within the premises of the Umno building.

In MALACCA, hundreds of youths from Umno and the Malaysian 4B Youth Movement held a demonstration to protest the statement by DAP national chairman Karpal Singh that Pakatan Rakyat was considering taking legal action against the Sultan.

The hour-long protest at noon Sunday saw several passing motorists honking in support.

Malacca 4B youth chairman Nohd Nizar Omar said the joint protest showed that youths here were against the opposition leadership, in particular Karpal who has called into question the Sultan’s power.

“Malacca may not have a Sultan anymore but we have to be taught to uphold the second tenet of the Rukun Negara that calls for loyalty towards the rulers,” he said.

He claimed that Karpal’s statement was tantamount to treason and he should be taken to task for it.

Karpal was quoted at a press conference on Friday as saying that the legal action should be regarded as a reminder that the Ruler was required to act within the confines of the Perak Constitution.

His statement was made with regard to Datuk Dr Zambry Abdul Kadir’s appointment as Perak Mentri Besar.

Melaka Tengah Umno youth deputy chief Shahadan Othman called on the authorities to take action against Karpal as his statement could cause “racial discord.”

“The Sultan is highly revered by all. His (Karpal’s) statement is seen as a challenge against Malay rights and this could lead to racial tension,” he added.

Police later dispersed the group which then accompanied Shahdan to lodge a report against Karpal at the Melaka Tengah district police station.

Perak — a failed democracy

FEB 7 — From a legal point of view I was made to understand that the power of the Sultan of Perak to disallow the dissolution of the state assembly is a grey area. What is obvious is the Sultan does not have the power to dismiss the serving menteri besar other than through a vote of no confidence.

Another grey area is whether the Sultan should accede to the request by the menteri besar to dissolve the assembly or whether he can act on his own prerogative to allow it or not.

I am not a legal specialist. Legal experts such as Malik Imtiaz have argued eloquently on this matter. However, as a legal expert His Royal Highness should understand that what is legal may not necessarily be moral or democratic. After taking full legal consideration, to allow the installation of the BN government in Perak has confirmed the Sultan's oversight on important elements such as democracy, morality and stability of the state government.

There are three grounds which I found the Sultan to have erred in his decision.

First, it is obvious that he did not weigh the sustainability and stability of the new government, which gained power through the backdoor. On this ground, the popularly elected Pakatan Rakyat government was brought down not through democratic means but through defections of its members to the opposition.

Legally, the constitution provides for freedom for association but this freedom is not absolute. We need to study this freedom of association in the context of a state or federal government. Malaysia practises party politics and most of its elected members are linked to political parties. The ruling coalitions are made up of political parties.

Hence, it is not democratic to allow for any defections which may easily threaten the stability of an elected government. Moreover, the three assemblymen who defected did not give any public explanation to justify their decision to defect. They even tried to get the public to believe that they were busy with their respective commitments.

Next, the Sultan has failed to conduct a test of character on the three defectors who are key to the change of government. If a test of character is conducted, the three assemblymen would have a problem to justify their defections. Firstly, two of the three are facing corruption charges and are due to face the court on Feb 10. If found guilty, they would have to vacate their seats.

Hence, it is obvious that even the new BN government, supported mainly by the three assemblymen, is not stable. Thus, it is in the interest of the Sultan to ensure that the probability of such an unstable government should not be allowed to exist. His Royal Highness should have appointed a caretaker government, at the very least, before their cases are called and argued in court. The assembly speaker has filed a case against the three defectors claiming that they have resigned. This case should be allowed to go to the court too.

It is obvious that the claim that they were made to sign the resignation letters under duress is hard to prove. It is part of employment terms since the three held important positions in the Perak state government.

On this point, the Sultan has failed conduct a morality test on the three. There are reasons to believe that their defections may worsen the negative conduct and practice in politics. This conduct is detrimental to the people if they are allowed to be part of the new government.

Third, the Sultan had initially indicated his choice of a unity government. This term is greatly misunderstood by His Royal Highness. There is no unity if the largest faction of the assembly is not included in the new government. A unity government formed between the BN and three so-called "independents" is not sensible and defeats the real meaning of unity.

All points considered, I believe the new government will be even more unstable than the previous one. Moreover, the manner in which the state secretary and the police who acted in an unconstitutional and irresponsible manner against the incumbent elected menteri besar has worsen public outrage. Politicians, especially those from the BN, should learn to respect the democratic process and the rule of law.

Perceptions are a powerful force. The perceptions formed on the BN and the new Perak are government detrimental to its rule.

The decision to unconstitutionally dismiss the elected MB and his administration is a bad decision of the Sultan’s part. It is obvious that the decision has failed the democratic and morality test.

The manner in which the incumbent government was toppled is illegal. Malaysians must learn an important lesson. It is they who can protect and defend their beloved democracy and constitution, not the politicians and not even the royalty.

"There is nothing unconstitutional and we were always abiding by the decision of the Sultan. The Sultan has acted in accordance with the constitution," said Najib.

"They wanted to topple the federal government by stealing 31 members of Parliament from BN.

"Please ask Pakatan Rakyat why did they start this subject? Weren't they the ones that announced that they wanted to establish a government on Sept 16 last time?"

PETALING JAYA: Datuk Seri Mohammad Nizar Jamaluddin is still the Perak Mentri Besar until he resigns of his own accord, or is removed by a vote of no-confidence in a formal sitting of the State Assembly, said Tengku Razaleigh Hamzah.

“Only the answer of the assembly counts, regardless how many sworn statements, defections, press conferences and declarations, or what forms of advertisement, display, inducement or force you bring to bear on the question,” he said in a statement yesterday.

“The Constitution makes no provision for his removal by any other means, including by petitions or instructions from any other authority,” he added.

He also said that a legitimate constitutional government draws all its authority from the consent of the people and only from that consent. The people consent because it is their government formed according to their constitution, whose leader is chosen through free and fair elections.

“To formally test the mandate of the current government, the question must either be put to the people through state elections, or to assemblymen through a formal vote in the Dewan,” said Tengku Razaleigh.

IPOH: The Ipoh Barat PKR Youth has lodged a police report to counter the one made by its Umno counterpart for suggesting Ipoh Barat PKR division chief Fauzi Muda was slanderous in accusing Umno deputy president Datuk Seri Najib Tun Razak of buying over Pakatan Rakyat assemblymen in the state.

Ipoh Barat PKR Youth chief V. Subramaniam filed the report at the Sungai Senam police station in Ipoh, refuting that there were elements of slander which might lead to a civil unrest in the state.

"On Feb 3, Ipoh Barat Umno Youth lodged a police report against Fauzi in connection to the statutory declaration he made where he claimed Datuk Seri Najib had bought over PR assemblymen for RM50mil.

"Since this case is now being investigated by the Malaysian Anti Corruption Commission, we ask that the party involved be patient and refrain from speculating until the investigations are complete," he told reporters.

On Feb 3, Ipoh Barat Umno Youth chief Syamsul Baharin Putra Ahmad Shibi said that Fauzi's declaration was defamatory as it described Najib as immoral and corrupt.

"The statutory declaration has caused anxiety and dissatisfaction, besides raising doubts among the public," he said.
