‘Charge MACC officers with criminal offence’

PETALING JAYA: Attorney-General Abdul Gani Patail should consider criminal charges instead of merely taking disciplinary action against MACC officers who drove Selangor political aide Teoh Beng Hock to suicide.

Lawyer representing the Teoh-family, Gobind Singh Deo, said that Abdul Gani should consider using Section 330 of the Penal Code which is the offence of “voluntarily causing hurt to extort confession…”. He argued that he believes that “hurt” should encompass mental injury as well.

Abdul Gani was quoted in the local daily New Straits Times on Friday that action against three MACC officers “for their aggressive, inappropriate and (therefore) in violation of the regulations”, as indicted in the Royal Commission of Inquiry (RCI) report, is to be read with the understanding of the word “regulations”.

Calling it the “final straw which broke the camel’s back,” the report claimed that the session must have wrecked the 30-year-old political aide mentally and physically.

The 124-page report also fingered three Malaysian Anti-Corruption Commission (MACC) officers as the main culprits and assigned them nicknames. The report was released by Minister in the Prime Minister’s Department Nazri Abdul Aziz today.

In stating that Teoh had to deal with “interrogation heavyweights”, the RCI labelled Selangor MACC deputy director Hishammuddin Hashim as the “arrogant leader (who would have no qualms in lying as long as the ends were achieved, regardless of the means employed)”.

RCI: ‘Weak-willed’ Teoh committed suicide

KUALA LUMPUR: Former Selangor political aide Teoh Beng Hock was not murdered but had committed suicide due to the aggressive interrogation by three Malaysian Anti-Corruption Commission (MACC) officers.

This was the conclusion of the Royal Commission of Inquiry (RCI) tasked with investigating Teoh’s cause of death.

Revealing this in Parliament today, Minister in the Prime Minister’s Department Mohd Nazri Abdul Aziz said that based on the report, action would be taken against the MACC officers for not following procedure.

In 2009, Teoh Beng Hock was a 30-year old journalist cum political aide looking forward to his coming marriage. In 2011, Ahmad Sarbani Mohamed was a 56-year old Customs Department’s Assistant Director and a devoted family man.

The two are seemingly worlds apart, one was about to start a new chapter in his life and another was looking forward to his retirement.

In the wake of the latest controversy involving the suspicious death of a Customs officer found dead at one of its premises, it is timely to take a good look at the Malaysian Anti-Corruption Commission.

In July 2010, the MACC operation review panel said that the media should “protect” the anti-graft body in order to encourage foreign direct investment into the country.

During a press conference at the Malaysian Anti Corruption Academy (MACA), Aminah Pit Abd Raman said the press had been unfair in its coverage of the MACC: “We are talking about image. This is the country that we love, you are the press. You can write one negative article that will effect investment for an example but you can also highlight the positive things.”

‘Did you put words into Teoh’s mouth?’

KUALA LUMPUR: A Malaysian Anti-Corruption Commission (MACC) officer was today grilled on whether he had put words into Teoh Beng Hock’s mouth and on the process of questioning witnessess.

The enforcement officer Mohd Nazri Ibrahim was testifying before the Royal Commission of Inquiry (RCI) into Teoh’s death.

Nazri had recorded Teoh’s statement prior to the DAP politicial aide’s death in July 2009.

Commission chairman James Foong asked Nazri what was the meaning of the phrase “recording statement” and concluded that although it was a “nice word”, it however still meant that the witness was interrogated.

MACC man: Teoh’s death angered me

KUALA LUMPUR:  A Malaysian Anti-Corruption Commission (MACC) officer said today that he felt angry, not guilty, over the death of Teoh Beng Hock.

Continuing with his statement before the Royal Commission of Inquiry (RCI) investigating the death and MACC’s interrogation methods, Mohd Anuar Ismail said the tragedy caused problems for him and his family.

Teoh was found dead the morning after his overnight interrogation by MACC officers at their office in Shah Alam. He was political aide to Ean Yong Hian Wah, the Selangor state executive councillor the agency was investigating for alleged misappropriation of funds. His body was found on the fifth floor of Plaza Masalam, the same building that houses the MACC office.

‘Violent’ MACC officer grilled over reports

KUALA LUMPUR: A Selangor Malaysian Anti-Corruption Commission (MACC) officer today admitted that police reports have been lodged against him for using violence during interrogation.

However, assistant enforcement officer Mohd Ashraf Mohd Yunus, 27, told the Royal Commission of Inquiry investigating Teoh Beng Hock’s death that he could not recall how many such reports were lodged.

“You don’t remember?” the witness was quizzed by RCI chairman James Foong.

“Do u want us to remind you? We can refresh your memory, do you want us to remind you or do you want to tell us on your own?”

“Was it nine (reports)?” he added, but Ashraf shook his head and repeated that he could not remember.
