IPOH: Datuk Seri Mohammad Nizar Jamaluddin will file an application at the High Court on Tuesday to declare as unconstitutional and illegal the swearing in of Datuk Dr Zambry Abdul Kadir as Perak Mentri Besar.
Nizar said Perak was currently facing a constitutional crisis as he had not resigned from his post.
“There are now two Mentris Besar because I am still the legitimate Mentri Besar. And the exco is still legitimate as well,” he said here on Friday.
He appealed to Perak’s Sultan Azlan Shah to follow the provisions in the state constitution, where he claimed he could only be forced to vacate his post if he resigned or faced a no-confidence vote in an emergency motion at the state assembly.
Nizar also slammed news reports in some dailies, which alleged that he was going to file a suit against the Perak royalty over the appointment of Dr Zambry.
“I have no intention whatsover to sue the royalty. It is a lie,” he said.
Instead, Nizar said he was trying to uphold and defend the dignity of the royal institution by appealing to the Sultan to act according to legal provisions.
“I am trying to uphold the dignity of the royal institution so that it won’t be perceived to be on the side of any particular political party,” he said.
Nizar told this to reporters at the Perak Mentri Besar’s official residence, where he is still staying and has refused to vacate.
“I don’t have a house and this is where my wife and children are staying. I have no where to go, and I don’t have to go,” he said, adding that he would also not hand over his official car as well.
Asked what would happen if the new state government or state secretary forcefully evicted him, he said: “I don’t think they will.
“When we took over, we didn’t put pressure on the previous Mentri Besar (to leave). He stayed for about a month (after the general election),” he said.
Nizar also distanced himself from the unrest in Kuala Kangsar, saying he did not orchestrate the demonstration.
“What happened was the uprising of the people who felt they had been betrayed by the formation of an illegal government,” he said.

The television coverage was disgustingly one-sided. Even a fool can see that. People began switching off their sets.
There is no need for MB Nizar to explain himself. BN is trying hard to discredit him and project him to the people as being disrespectful to the Sultan. Like they did when MB Nizar sacked that UMNO islamic fellow. Unfortunately, it will not work this time because it is the Rakyat who is angry with the Sultan.
